European Court of Justice rules on holiday rights for the long-term sick
The European Court of Justice ("ECJ") have ruled in Stringer and others v HM Revenue & Customs that a worker on sick leave accrues annual leave whilst absent. However, the court decided that it is for national law to determine whether a worker can take that annual leave during a period of sick leave or whether they are able to carry it over. This question will now be left to the House of Lords to determine.
