The Government has announced that it plans to introduce "fit notes" to replace sick notes in an effort to cut the amount of money lost to the economy from workplace absenteeism.

Employment Appeal Tribunal overturns Tribunal decision on reinstatement of ex-employee

In Central & North West London NHS Foundation Trust -v- Abimbola the EAT has overturned a decision of the Watford Tribunal to order the re-instatement of an ex-employee.  In doing so the EAT has highlighted the relevant factors which should be considered in making an order for re-instatement.

Answers to pre-employment medical questionnaire were not misrepresentations

The High Court has ruled in Cheltenham Borough Council v Laird that the Council did not have a claim for misrepresentation against a former senior employee.  The Council had argued that in failing to mention her history of stress and depression in a pre-employment medical questionnaire the employee had made misrepresentations about her health.
