In Secretary of State for the Department of Work and Pensions v Alam the EAT has reviewed the extent to which employers can rely on the exemption from making reasonable adjustments contained in section 4A(3)(b) of the Disability Discrimination Act 1995 where they are not aware of an employee's disability.
