High Court refuses to imply a contractual term that eligibility under a Company bonus scheme is dependant on continued employment at the payment date
In Rutherford v Seymour Pierce Ltd, the High Court rejected an employer's argument that there was an implied contractual term that to qualify for payment under the Company bonus scheme, an employee must, at the payment date, still be employed and/or not under notice of termination of employment.
