Employees' delay in resigning was not fatal to claims of Constructive Dismissal
In Munchkins Restaurant Ltd and another v Karmazyn and others, the EAT was sympathetic towards a group of employees, all of whom had delayed in resigning their employment after, in some cases, years of 'intolerable' conduct. The EAT found that their delay in resigning did not amount to an affirmation of their employment contracts.
